In Wisconsin, you may watch up to 3 counted children before a license is required — and Wisconsin counts your own children (under 7) in that number.
Licensing agency: Wisconsin Department of Children and Families (DCF) — licensing is state-level; CERTIFICATION runs through county and tribal agencies
The line: In Wisconsin, you may watch up to 3 counted children before a license is required — and Wisconsin counts your own children (under 7) in that number.
Your own children: counted — Wisconsin includes your own children (under 7) in the numbers that decide your category.
Even below the line: At 1–3 unrelated children under 7 you may stay unlicensed — or become CERTIFIED through your county or tribal agency. Certification is voluntary for private pay, but it is required to receive Wisconsin Shares subsidy families.
| Category | Capacity | What it means |
|---|---|---|
| Certified Family Child Care (DCF 202) | up to 6 | 1–3 unrelated children under 7, with a maximum group size of 6 total — your own children under 7 count inside the 6; children 7 and older do not. |
| Licensed Family Child Care Center (DCF 250) | up to 12 | 4 to 12 children — the 12-child cap (effective August 1, 2026; it was 8 before) counts all children under 7 including your own, plus all non-own children 7 and older. At 13 or more children the program is a group child care center. |
Wisconsin splits the doors: DCF licenses, but CERTIFICATION for small home providers is administered by county and tribal agencies (in Milwaukee County, by DCF itself). Your certification door is your county agency, not Madison.
